Direct or indirect discrimination related to any of the aforementioned factors, as outlined in this policy, is strictly prohibited and will not be tolerated under any circumstances.
Direct discrimination occurs when an individual is treated less favorably than others due to possessing one of the mentioned factors. This policy also covers situations where individuals are treated unfavorably due to being perceived to possess these factors (discrimination by perception) or because they associate with someone who has one of these factors (discrimination by association).
Indirect discrimination arises when a company policy or practice disproportionately disadvantages individuals who share one of the mentioned factors and such treatment cannot be justified. However, it’s important to note that separate provisions exist to protect employees in circumstances related to pregnancy or maternity.
MK Hospital@Home is committed to taking all reasonable steps to prevent discrimination and to effectively implement this policy. Employees have a responsibility to cooperate with MK Hospital@Home to ensure the policy’s effectiveness and to ensure that all colleagues and clients are treated with respect and dignity.
Employees are encouraged to support colleagues who experience discrimination and are making a complaint. It is imperative that employees communicate their disapproval of such behavior and report any observed incidents promptly.
Victimizing or retaliating against an employee for making a discrimination report will be considered a disciplinary offense.
To file a discrimination complaint, employees should utilize Westmorland Homecare’s Grievance Procedure and may, if necessary, directly approach any Director. All complaints will be handled discreetly and confidentially, with appropriate action taken.
Employees should be aware that victimizing or retaliating against an employee for making a discrimination complaint, including taking actions that put the employee at a disadvantage, will be considered a disciplinary offense. Unlawful discrimination, as covered by this policy, may result in disciplinary action, including summary dismissal for gross misconduct.
